CESTAT Delhi Upholds Penalties for Concealed Memory Card Smuggling

In a significant enforcement and appellate ruling, the Customs, Excise and Service Tax Appellate Tribunal (CESTAT), Principal Bench, Delhi, upheld penalties and confiscation orders against an importer involved in smuggling undeclared memory cards concealed within commercial imports. The ruling confirms the Indian customs authorities’ vigilance in detecting deliberate mis-declarations and concealment of goods designed to evade customs duties.


The case arose from the import of a consignment from Hong Kong, declared as “clips for multimedia cards (metal parts)” in the Bill of Entry. Upon examination by customs officials, the shipment was found to contain 3,080 undeclared memory cards (1 GB each) hidden inside the declared clips and adaptors. The Directorate of Revenue Intelligence (DRI) initiated an investigation, issuing a show-cause notice for confiscation, recovery of differential customs duty, and imposition of penalties under relevant provisions of the Customs Act, 1962. The importer had allegedly used another company’s Import Export Code (IEC) and misrepresented the consignment to conceal the true nature and value of the goods.


The adjudicating authority confirmed the smuggling and imposed confiscation and penalties. On appeal, the importer challenged the findings, citing procedural issues and contesting the classification and valuation of the goods. CESTAT, after reviewing the case, upheld the findings of mis-declaration and concealment, noting that adequate personal hearing opportunities had been provided and that the suppression of material facts was deliberate. The tribunal affirmed the differential duty, confiscation of the smuggled goods, and penalties under Sections 111 and 114A of the Customs Act, reinforcing the principle that attempts to evade customs duty through concealment or false documentation would not be tolerated.


This decision underscores the Indian customs authorities’ ongoing focus on curbing smuggling and illegal import practices. It highlights the importance for importers and logistics intermediaries to maintain transparent documentation, full disclosure of consignment contents, and compliance with customs regulations, as deliberate attempts at misrepresentation are met with strict enforcement and substantial penalties.
