Announcement No. 91 of 2025: Catalogue of Dual-Use Items and Technologies Subject to Import and Export Licence Administration (2026)

On 31 December 2025, China’s Ministry of Commerce (MOFCOM), together with the General Administration of Customs (GACC), issued Announcement No. 91 of 2025, formally releasing the 2026 Catalogue of Dual-Use Items and Technologies Subject to Import and Export Licence Administration. The catalogue defines the scope of goods and technologies that require licensing due to their potential civilian and military applications.
The 2026 catalogue was issued pursuant to the Export Control Law of the People’s Republic of China, the Regulations on the Export Control of Dual-Use Items, and the Measures for the Administration of Import and Export Licences for Dual-Use Items and Technologies. It replaces the previous catalogue issued under MOFCOM and GACC Announcement No. 67 of 2024 and applies to all relevant import and export activities from 1 January 2026.
Under the updated framework, exporters and importers of listed dual-use items must obtain an import or export licence from MOFCOM or its authorized local counterparts before customs clearance. Customs authorities will release goods only upon verification of a valid licence. The catalogue provides detailed item descriptions and corresponding customs commodity codes, improving legal certainty and reducing classification ambiguity for traders.
The announcement also reiterates cross-agency approval requirements for specific categories of goods. For example, imports involving radioactive isotopes remain subject to prior approval from the Ministry of Ecology and Environment before a dual-use import licence can be issued. This reflects China’s integrated regulatory approach to sensitive materials.
According to MOFCOM, the updated catalogue aims to strengthen regulatory clarity, enhance compliance efficiency, and align export control administration with technological and security developments. Companies involved in manufacturing, cross-border trade, logistics, or technology transfer should review the 2026 catalogue carefully, reassess product classifications, and update internal compliance procedures to ensure full adherence to China’s dual-use export control requirements in 2026.
