The U.S. Consumer Product Safety Commission (CPSC) has issued updated guidance confirming the scope and implementation details for its upcoming mandatory electronic filing (eFiling) of certificates of compliance. Effective July 8, 2026, importers will be required to submit compliance certificates through an automated eFiling process at the time of importation.
A key feature of the guidance is the publication of a comprehensive list of approximately 600 Harmonized Tariff Schedule (HTS) codes that fall within the mandatory eFiling requirement. These HTS codes broadly cover consumer products subject to CPSC safety rules, including items regulated under the Consumer Product Safety Act (CPSA) and related statutes. The list is intended to help importers, manufacturers, and customs brokers identify which products must be supported by electronically filed certificates.
Under the new framework, compliance information will be transmitted directly to U.S. Customs and Border Protection (CBP) through the Automated Commercial Environment (ACE), enabling earlier risk assessment, improved targeting, and faster identification of non-compliant products. The CPSC has emphasized that this shift is designed to enhance supply chain transparency, strengthen consumer product safety oversight, and reduce reliance on manual or paper-based documentation.
With the effective date now set, companies are encouraged to begin assessing product classifications, reviewing affected HTS codes, and upgrading internal compliance systems and data flows. Early preparation will be critical, as failure to provide accurate and timely electronic certificates may result in shipment delays, refusals of admission, or enforcement actions. The guidance signals a significant modernization of U.S. product safety compliance, and a clear expectation that industry be ready well before July 2026.
