The European Commission has formally opened an in-depth enforcement investigation against SHEIN under the Digital Services Act (DSA), reflecting heightened regulatory scrutiny of large online platforms operating in the EU. Published on 17 February 2026, the official European Commission press release outlines the Commission’s concerns that SHEIN, a major global fast-fashion e-commerce operator, may be failing to meet core DSA obligations intended to protect consumers and ensure the transparency and safety of digital services.
At the heart of the Commission’s action are systemic risks and potential legal breaches including the sale of unsafe and illegal products, inadequate mechanisms for detecting and removing harmful goods, and shortcomings in algorithmic transparency. The investigation will assess whether SHEIN’s recommendation systems and ranking mechanisms sufficiently safeguard users against exposure to illegal content or risky products, and whether the platform provides clear information about how such systems operate.
The DSA investigation is significant because it applies to very large online platforms (VLOPs), which face enhanced obligations due to their scale and influence. Under the DSA framework, SHEIN is required to proactively manage systemic risks, conduct regular assessments, and implement mitigation measures where necessary. The Commission’s probe will examine compliance with rules on risk assessment, data access for research, and transparency reporting, particularly in relation to consumer protection and product safety.
The formal opening of the investigation initiates a structured enquiry during which SHEIN must engage with regulators and provide information to address the Commission’s concerns. Depending on the findings, the Commission can impose corrective orders and fines of up to 6% of global turnover under the DSA regime.
