On 27 January 2026, the U.S. Department of Commerce issued both Antidumping Duty (AD) and Countervailing Duty (CVD) orders covering thermoformed molded fiber products imported from China and Vietnam, following the conclusion of its trade remedy investigations.
The Antidumping Duty Order, published at 91 FR 3431, applies under case numbers A-570-182 (China) and A-552-845 (Vietnam). Commerce determined that these products were being sold in the United States at less than fair value, causing material injury to the domestic industry. U.S. Customs and Border Protection (CBP) is instructed to assess antidumping duties on entries of the covered products according to the final dumping margins established by Commerce.
Simultaneously, the Countervailing Duty Order, published at 91 FR 3437, under case numbers C-570-183 (China) and C-552-846 (Vietnam), found that producers and exporters in both countries received countervailable subsidies. CBP will collect cash deposits at the applicable subsidy rates for imports of these thermoformed molded fiber products.
The orders cover “Thermoformed Molded Fiber Products” (TMFPs), including plates, bowls, clamshells, trays, and lids. These are primarily classified under HTSUS 4823.70.00. The orders require continued suspension of liquidation for entries of the subject merchandise and the collection of cash deposits for future imports. These measures remain in effect unless modified, revoked, or terminated through administrative or sunset reviews.
By targeting thermoformed molded fiber products, these actions demonstrate the U.S. trade authorities’ commitment to addressing unfair pricing and subsidization practices, ensuring a level playing field for domestic manufacturers, and maintaining compliance obligations for importers sourcing these products from China and Vietnam.
